Welcome to noir10.com (the "Site"), operated by Grip Media ("we," "us," or "our"). By accessing or purchasing from this Site, you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully before placing an order.
1. Overview
NOIR10 sells original fine art photography of neon signs, cyberpunk scenery, and other luminous subject printed on translucent film and built into custom backlit LED frames. Each piece is handmade and produced in limited quantities. By using this Site, you confirm that you are at least 18 years old or are using the Site under the supervision of a parent or guardian.
2. Products and Availability
- All product descriptions, images, and pricing are subject to change without notice.
- Because pieces are handmade in small batches, slight variations in color, framing, or finish between the photo shown and the item received are normal and not considered defects.
- We reserve the right to limit quantities, discontinue a piece, or refuse any order at our discretion.
- Custom or commissioned pieces may be subject to separate terms communicated directly at the time of the request (timeline, deposit, revisions, etc.).
3. Pricing and Payment
- All prices are listed in USD and do not include applicable taxes or shipping unless stated otherwise.
- Payment is processed securely through our third-party payment provider at checkout. We do not store your full payment card details.
- We reserve the right to correct pricing errors, even after an order has been placed, and will contact you before processing if this occurs.
4. Shipping
- Orders are shipped via USPS/UPS through PirateShip.com to the address provided at checkout. It is your responsibility to ensure the shipping address is accurate.
- Estimated shipping times are provided for convenience and are not guaranteed. We are not responsible for delays caused by the carrier.
- Because these are framed, glass- or acrylic-faced pieces, we take care in packaging, but risk of loss or damage in transit passes to the carrier once the package leaves our hands. See Section 5 for our damage policy.
- We currently ship within the United States. International shipping is offered via special orders.
5. Damaged, Lost, or Defective Items
- If your piece arrives damaged, contact us within 5 days of delivery at deliveries@noir10.com with photos of the item and packaging. We will work with you on a replacement, repair, or refund.
- Shipments are insured; claims for lost or damaged packages may require your cooperation in filing a carrier claim.
6. Returns and Exchanges
- Except for damaged units in shipment, our policy is generally to not accept returns because each piece is handmade, produced in limited quantities and produced on-demand. We will consider a return on a case by case basis provided the item is unused and in its original packaging. Contact us for return consideration at returns@noir10.com
- Custom or commissioned pieces are final sale unless the item arrives damaged or defective.
- Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective item.
- To initiate a return, contact us at returns@noir10.com before shipping anything back.
7. Intellectual Property
- All photographs, images, designs, and content on this Site are the original work of Noir10.com / Jerry Chrisman and are protected by copyright. All rights are reserved.
- Purchasing a physical piece does not transfer any copyright, reproduction rights, or licensing rights in the underlying photograph. You may not reproduce, scan, photograph for resale, digitize, or create derivative works from any piece without our prior written consent.
- The Noir10 name, logo, and branding may not be used without permission.
8. Acceptable Use
When using this Site, you agree not to:
- Use the Site for any unlawful purpose
- Attempt to interfere with the Site's security or functionality
- Copy, scrape, or republish Site content without permission
- Submit false or fraudulent order information
9. Limitation of Liability
To the fullest extent permitted by law, Noir10.com is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
10. Disclaimer of Warranties
Products are sold "as is." While we take care in construction and quality control, we do not guarantee that LED components will be free of defects beyond the warranty period stated at the time of sale, if any. 11. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the courts located in Multnomah County, Oregon.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
